2. DEFINITIONS
In these Terms and Conditions, unless the context indicates otherwise:
- “Client” means any individual, company, or organisation that purchases or engages KLMJ Holdings training services.
- “Learner” means any individual enrolled in a training programme offered by KLMJ Holdings.
- “Services” means all security training, OHS training, assessments, consultancy, and related services provided by KLMJ Holdings.
- “Training Programme” means any course, workshop, assessment, or learning intervention offered by KLMJ Holdings.
- “Website” means the KLMJ Holdings website accessible at www.klmjholdings.co.za.
- “Applicable Law” means all relevant South African legislation, regulations, and industry standards applicable to the Services.
3. OUR SERVICES
KLMJ Holdings provides the following services:
- PSIRA-accredited security training programmes (Grade A through Grade E)
- Occupational Health and Safety (OHS) training including HIRA, incident investigation, legal liability, and first aid
- SETA-accredited skills development programmes and learnerships
- Workplace health and safety audits and compliance consultancy
- Customised in-house training solutions for corporate and institutional clients
All training programmes are subject to availability. KLMJ Holdings reserves the right to amend or discontinue any programme to remain compliant with legislative and regulatory requirements, without prior notice.
4. ENROLMENT AND REGISTRATION
4.1 Enrolment in a training programme is subject to completion of a registration form and payment of the applicable fees.
4.2 Clients and Learners must provide accurate, complete, and current information during registration. KLMJ Holdings is not liable for any consequences arising from inaccurate or incomplete information.
4.3 Admission to any training programme is at the sole discretion of KLMJ Holdings. We reserve the right to decline enrolment without providing reasons.
4.4 Learners must meet the entry requirements prescribed for each programme, including minimum literacy levels, physical fitness standards where applicable, and any pre-requisite qualifications.
4.5 Learners must be at least 18 years of age unless otherwise specified, and must possess a valid South African identity document or equivalent recognised identification.
5. FEES, PAYMENT, AND CANCELLATIONS
5.1 All fees are quoted in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated.
5.2 Full payment or a confirmed purchase order is required prior to commencement of training, unless a formal credit arrangement has been agreed upon in writing.
5.3 KLMJ Holdings reserves the right to amend fees at any time. Fees applicable at the time of confirmed registration shall apply.
5.4 Cancellations by the Client must be submitted in writing. The following cancellation policy applies:
- More than 10 business days before commencement — No cancellation fee
- 5 to 10 business days before commencement — 25% of the total course fee is forfeited
- Less than 5 business days before commencement — 50% of the total course fee is forfeited
- No-show or cancellation on the day of training — 100% of the total course fee is forfeited
5.5 KLMJ Holdings reserves the right to cancel or reschedule any training programme due to insufficient enrolment, unforeseen circumstances, or force majeure. Affected clients will be offered an alternative date or a full refund.
6. LEARNER CONDUCT AND ATTENDANCE
6.1 Learners are required to maintain professional conduct at all times during training. KLMJ Holdings reserves the right to remove any Learner who engages in disruptive, dishonest, abusive, or unsafe behaviour, without refund.
6.2 Full attendance at all scheduled sessions is required. Learners who miss more than 20% of contact sessions may be required to repeat the programme at their own cost.
6.3 The use of mobile phones and electronic devices is restricted to authorised activities only during training sessions.
6.4 All Learners must comply with health and safety requirements on training premises at all times.
7. ASSESSMENTS AND CERTIFICATION
7.1 Learners must complete all assessments as prescribed by the relevant SETA, PSIRA, or awarding body. KLMJ Holdings does not guarantee any specific competency outcome.
7.2 Certificates and statements of results are issued only upon successful completion of all required assessments and verification by the relevant awarding body.
7.3 KLMJ Holdings will not issue fraudulent or unearned certification under any circumstances. Certification is issued solely upon genuine demonstrated competency.
7.4 Appeals against assessment decisions must be submitted in writing within 10 business days of receiving results.
8. INTELLECTUAL PROPERTY
8.1 All training materials, course content, manuals, presentations, and learning resources provided by KLMJ Holdings are proprietary and protected under South African copyright and intellectual property law.
8.2 Clients and Learners may not reproduce, distribute, publish, resell, or commercially exploit any KLMJ Holdings materials without prior written consent.
8.3 KLMJ Holdings respects the intellectual property rights of third parties and expects the same of all Clients and Learners.
9. LIMITATION OF LIABILITY
9.1 KLMJ Holdings provides training for educational and compliance purposes. We do not guarantee employment or any specific professional outcome resulting from completion of any programme.
9.2 KLMJ Holdings shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to the Services, including loss of income, loss of opportunity, or loss of data.
9.3 To the maximum extent permitted by Applicable Law, KLMJ Holdings’ total liability shall not exceed the fees paid by the Client for the specific programme giving rise to the claim.
10. INDEMNITY
Clients and Learners indemnify KLMJ Holdings and its directors, employees, agents, and contractors against any claims, losses, damages, or expenses arising from: (a) breach of these Terms and Conditions; (b) negligent or unlawful conduct by the Client or Learner; or (c) inaccurate or misleading information provided during registration.
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.
11.2 Any dispute arising from these Terms and Conditions shall first be referred to mediation. Should mediation fail, the parties consent to the jurisdiction of the South Gauteng High Court or such other competent court.

- Training records are retained for a minimum of 5 years in compliance with SETA and regulatory requirements
- Financial records are retained for a minimum of 5 years in accordance with the Companies Act and SARS requirements
- Where information is no longer required, it will be securely destroyed or anonymised
